“41. The stalking,
harassment and confrontations by Rita Hardin have continued to increase in
scope. As part of her campaign to intimidate Douglas A. Hardin and Melissa Martinelli-Hardin, she has encouraged and aided in the publication of information about this
action and her allegations against Douglas A. Hardin and Melissa Martinelli-Hardin. She has helped or encouraged the
publication of names and address of the children of Melissa Martinelli-Hardin
creating grave risk for their safety. A copy of the publication is attached as
Exhibit 13 and incorporated by reference herein. The publication of the names
of the children is of such concern that as a condition of her bond for the

County Assistant District Attorney, David Fife, who says he’s “investigating”
this case in blue, Gwinnett
Daily Post in purple, Tommy Flanagan in maroon:
Now
wait a minute Hoss. Rita Hardin had nothing to do
with my web site. Melissa Martinelli-Hardin published
the names of her children on the Internet for several years, long before I ever
knew about the Hardin case. I learned about the Hardin ‘relocation’ case by way
of Chris McFadden, Rita’s appellate attorney, who inquired about feminist law
organizations writing an amicus curiae brief.
After
reading about the Hardin case, I was interested in the relocation or
‘move-away’ aspects as I have been following this topic in family law circles
for several years. So, I contacted Rita Hardin, not the other way around. At
that time I had no idea of the abusive litigation tactics that Douglas A.
Hardin and Melissa Martinelli-Hardin were planning
with the aid of their attorney, Warren Auld. Or that’s what Melissa wrote on
the Internet on the 2nd Wives Club message boards.
At
no time did I ever publish Douglas and Melissa Hardin’s address. I did publish
the Consent Order, which had Melissa’s children’s names on it, not with the
intent to publish their names, Melissa had already
done so, as David Fife, the Assistant District Attorney assigned to investigate
this case, pointed out in an e-mail. Not only had Melissa published their
names, but all of their pictures as well. As a condition of bond, Rita agreed:”
4) Defendant shall not publish or have another person or entity publish by
means of Internet or any other means of publication the names of Melissa
Hardin’s children[.]” In reality,
”Thanks for pointing out Melissa's paragraph which contained the names of
her children. Missed
that one. However, it concerns me that my websites are a condition of
Rita's bond. I am not a party to this case, and therefore I am not under
-- Vicki Pierce email to David Fife
”No. The
condition is that Rita not publish or have anyone else
publish the names of Melissa’s children. (Photos of her kids are already
published by Melissa herself on that website). …The website issue is more a courtesy request
that I thought was reasonable. We typically do not publish the names of
children under the age of 16 unless they are charged with an adult crime.
So with child victims etc we try not to do that. Thus, as a courtesy, I
would ask that you not publish the names of children unless you have the
permission of the legal guardian. As to the condition that you have a
problem with, Rita agreed to it so it remains a condition of pre-trial
release. What issues of proof would be required at a revocation hearing
based on that condition would be a matter for the judge—likely some connection
between Rita and someone at the website will have to be shown.”
-- David Fife email to Vicki Pierce
Furthermore,
Rita Hardin has not encouraged or aided in the construction of my web sites. My
web site was NOT designed as a “campaign to intimidate” Douglas A. Hardin and
Melissa Martinelli-Hardin. They’ve done enough
intimidating on their own. They’re the bullies here. Last I heard custody and
criminal cases are public record. Anyone can go down to the county courthouse
and look this garbage up. Since, Warren Auld has announced his intention to run
for Phyllis Miller’s 106th District State House seat, maybe he’s the
one who’s really intimidated -- as his litigation history might not sit too
well with
The
web sites were designed for informational purposes, mainly for national family
law advocates who follow relocation and custody cases pertaining to, mostly
mothers, those who have been victimized by ‘custody switching.’ If they think
they can intimidate me, through their attorney, into deleting said web sites --
better educated folks and their attorneys have tried and failed miserably in
the past. Last I heard, this is a free country with
free speech guaranteed for all. As long as I speak the truth—and the truth
shall set us free—there is nothing that they can do about it, other than maybe
doing their own web site? Or, better yet, as someone recently emailed me, that
I don’t know all the facts about the Hardin’s case. So, I wrote this person
back, and asked, in the interest of truth, to supply me with said facts. Said
person did not write me back. I’ve done a lot of research on the Hardin case,
if there’s anything missing or false, I would sure like to find out about it.

Which is it,
saying that the city attorney asked for the meeting, or as in the memo from the
